Terms of Service, Safeguarding, Reviews & Liability Release
1. Acceptance of Terms & Conditions
By accessing the Aqeel Driving School website, interacting with our digital content, utilizing our online booking platforms, or enrolling in any of our in-car or online training programs, you acknowledge that you have read, understood, and explicitly agree to be bound by these comprehensive terms and conditions. If you do not agree with any part of these terms, you must immediately cease use of our services and platforms. These terms constitute a legally binding agreement between you (the student/user) and Aqeel Driving School.
2. Student Safeguarding, Safety Mandate, & Professional Conduct
The core of our operational philosophy is the uncompromising protection of our students.
- Top Priority: We affirm unequivocally that student safety, physical well-being, psychological comfort, and safeguarding are our highest institutional responsibilities.
- Instructor Vetting & Background Checks: To ensure a secure learning environment, we implement strict professional conduct guidelines. Furthermore, we require and actively maintain comprehensive background checks, including mandatory Vulnerable Sector Checks (VSC) through local law enforcement, for all instructional faculty, administration, and support staff.
- Vehicle Safety: All training vehicles are equipped with dual-brake control systems, undergo rigorous routine mechanical inspections, and carry commercial insurance specifically designed for driver instruction.
3. Reviews, Testimonials & Feedback Usage Rights
We value the feedback of our students and actively use it to improve our services and guide future students.
By submitting reviews, star ratings, written testimonials, photographs, or any form of feedback to Aqeel Driving School—whether submitted directly via email, through our website, or posted on third-party review platforms (such as Google, Yelp, or Trustpilot)—you grant Aqeel Driving School a perpetual, non-exclusive, royalty-free, and irrevocable right to publish, display, distribute, adapt, and utilize this content. This usage may occur across any marketing platform, social media channel, website, print media, or promotional material globally without further compensation or specific notification.
4. Liability Release, Assumption of Risk & Non-Suability Clause
Driver education inherently involves active participation in live vehicular traffic, which carries unavoidable risks.
- Inherent Risks Acknowledgment: You formally acknowledge, understand, and accept that motor vehicle operation, driver training, and being a passenger in a training vehicle carry inherent risks, including the severe potential for property damage, physical injury, psychological trauma, or death caused by accidents, third-party negligence, or unforeseen road conditions.
- Comprehensive Liability Release: By voluntarily participating in our training programs, you explicitly agree that if a student experiences anxiety, panic attacks, causes a collision, incurs physical injury, or suffers emotional distress during lessons, they unconditionally waive, discharge, and forfeit any right to sue, hold liable, or demand financial damages from Aqeel Driving School, its owners, directors, corporate officers, employees, agents, or instructors. This release applies to the absolute fullest extent permitted by the laws of Ontario.
- Mandatory Instructor Compliance: For the preservation of safety, students are strictly required to maintain self-control and follow all verbal and physical commands issued by the instructor promptly, accurately, and without hesitation. Failure to comply with instructor directives may result in the immediate termination of the lesson without refund.
5. Intellectual Property & Site Usage Restrictions
All digital assets, website content, textual copy, logos, branding elements, graphic design, proprietary instructional materials, curriculum structures, and software code are the exclusive intellectual property of Aqeel Driving School or its content suppliers. This intellectual property is protected by Canadian and international copyright and trademark laws. Unauthorized reproduction, distribution, modification, or commercial exploitation of any material found on our platforms is strictly prohibited and will be met with legal action.
6. Governing Law, Jurisdiction & Dispute Resolution
These Terms of Service, along with any separate agreements whereby we provide you services, shall be governed by and construed exclusively in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes arising from or relating to these terms, our services, or your use of our website shall be subject to the exclusive jurisdiction of the provincial and federal courts located within Ontario, Canada.
